NSO Group argues WhatsApp injunction threatens existence, future U.S. government work

NSO Group recently filed a motion in court requesting a stay on the permanent injunction barring it from using spyware against WhatsApp. The company argues that enforcing this injunction could result in existential harm and curtail law enforcement’s access to its technology, including Pegasus spyware. The motion emphasizes that the destruction of the necessary computer code is irreversible, significantly jeopardizing NSO’s business and permitting competitors to operate without similar restrictions.

The company insists that the injunction violates the Computer Fraud and Abuse Act, as it prohibits lawful investigative actions by U.S. law enforcement. NSO argues that the injunction also undermines public interest, as Pegasus is employed in serious criminal investigations. The company contends that the injunction would prevent FBI and other agencies from utilizing its products in future operations, thereby affecting national security and law enforcement capabilities. NSO claims its survival relies on the ability to engage in lawful conduct related to its technologies amidst the appeal against the injunction.
